1. The parties
emily-dublin.com is run by USEEMALL LTD, registered in England and Wales under company number 13324887, trading as Emily Dublin. Browsing or ordering means you accept what follows. None of it reduces the mandatory consumer rights Irish and European Union law gives you.
2. Age and accounts
You must have reached the age of majority where you live in order to buy. Where you hold an account, its credentials are yours to protect and its activity is yours to answer for. Contact us the moment you suspect otherwise.
3. Product descriptions
Measurements, materials and photography are prepared carefully. Screens still render colour differently and studio lighting still flatters a fabric. That variation comes with buying online and is not a defect. Where goods genuinely fail to match what we described, the Returns & Refund Policy takes over.
4. Orders and acceptance
Your order is an offer to buy. We may refuse or limit it — stock gone, payment unauthorised, an obvious pricing error, suspected fraud, or supply that would be unlawful. Where we cancel something already paid for, you are reimbursed in full without undue delay.
Goods are sold for personal or household use rather than commercial resale or export.
5. Price, currency and billing
Prices are in euro (EUR) and include VAT and other mandatory charges where applicable. They may change, but the binding price is the one shown when you ordered and repeated in your confirmation. Delivery and any other costs appear before payment. You confirm your billing details are accurate, current and yours to use. Payment mechanics live in the Payment Policy.
6. Delivery and risk
Delivery has happened once you, or a third party you nominated who is not the carrier, physically holds the goods. Until then the risk is ours. Timeframes are estimates; the detail is in the Shipping Policy.
7. Late or missing delivery
Where goods fail to arrive at the agreed time through no fault of yours, you may withhold payment, require delivery, set an additional period appropriate to the circumstances, end the contract and be reimbursed where the conditions are met, and claim compensation for documented loss where the law allows. This holds equally where the delay lies with a carrier we selected.
8. Withdrawal and returns
Fourteen days of statutory withdrawal on distance purchases, extended by us to a 30-day overall window. Deadlines, procedure, the withdrawal form, costs, reimbursement and lawful exceptions are all in the Returns & Refund Policy.
9. Conformity of goods
Goods must conform to the contract and to the Consumer Rights Act 2022. Where they do not, and you are not the cause, you may be entitled to repair, replacement, a proportionate price reduction, or termination with a refund. Claims may be brought for up to six years after delivery, and a fault emerging in the first twelve months is presumed to have existed at delivery unless we prove otherwise.
10. Intellectual property
Text, photography, graphics, logos and layout are ours or licensed to us. Personal, non-commercial use is welcome. Copying, redistributing or commercially exploiting them without written permission is not, except where the law expressly allows it.
11. Third-party tools
Some features are supplied by third parties, outside our control, offered as they are and without warranty. Their own terms apply.
12. Outbound links
We take no responsibility for the content of sites we do not operate, nor for purchases made on them.
13. Reviews and submissions
Send a review or photograph and you keep ownership while granting us a non-exclusive right to display and use it for the shop and its marketing. You confirm that publishing it infringes nobody's rights. Unlawful or offensive material may be removed. We never edit a review into something that misrepresents an opinion, and any review obtained through an incentive is disclosed as such.
14. Personal data
Handled as described in the Privacy Policy. Accepting these terms is not, by itself, consent to optional cookies, personalised advertising or marketing email.
15. Errors and corrections
Where a price, description or availability figure is wrong, we may correct it and cancel affected orders even after submission, with a full refund.
16. Prohibited uses
No unlawful purposes, no infringing anyone's rights, no harassment or abuse, no spam, no impersonation, no malicious code, no scraping or harvesting, no interfering with the security of the site. Breach may cost you access.
17. Warranties and liability
Beyond what we state expressly and what the law confers and forbids us to exclude, the site and its content are supplied as they are. Nothing here limits our liability further than the law permits, and mandatory consumer protection stands untouched. We are not liable for indirect losses that could not reasonably have been foreseen.
18. Indemnity
You will hold us harmless against third-party claims, including reasonable legal costs, arising from your breach of these terms or of the law, or from your use of the site.
19. Severability, termination and entire agreement
An unenforceable clause applies as far as the law permits and is severed for the rest, which stands. Either side may end the arrangement, with the clauses that ought to survive surviving. These terms and the policies linked from them are the whole agreement. Choosing not to enforce a right once waives nothing.
20. Governing law and disputes
Governed by the law of England and Wales, the jurisdiction in which USEEMALL LTD is registered. That choice cannot strip you of the protection of the mandatory consumer rules where you habitually live — if that is Ireland or elsewhere in the European Union, your national consumer law continues to apply.
Raise it with us first. Beyond that, the Competition and Consumer Protection Commission advises consumers in Ireland, and the European Consumer Centre Ireland assists with cross-border purchases in the European Union. The competent courts remain open to you.
21. Amendments
These terms are revised as the business and the rules change. The version in force when you ordered governs that order; later changes do not reach backwards. The date at the top shows the current text.
